1. About Us

This website is operated by MV Kudumine OÜ, a company registered in Estonia (registration number to be added), with registered address in Loksa, Estonia. Business email: info@vainowear.com.

By placing an order or using this website, you agree to be bound by these Terms & Conditions. Please read them carefully before making a purchase.

2. Products & Ordering

All products sold through vainowear.com are handmade to order by MV Kudumine OÜ in Estonia. Product photographs are representative; slight variations in colour, texture, and dimensions are inherent to handcrafted goods and are not considered defects.

By submitting an order, you make an offer to purchase. The contract of sale is formed when we send you an order confirmation email. We reserve the right to refuse or cancel any order at our discretion (e.g. due to stock unavailability, pricing errors, or suspected fraud), in which case a full refund will be issued promptly.

3. Prices & Payment

All prices are displayed in Euros (€) and include Estonian VAT (20%) where applicable. We reserve the right to change prices at any time without notice; the price charged will be the price confirmed at the time of your order.

Payments are processed securely via Stripe. We do not store your payment card details. By paying, you confirm the transaction is authorised. In the event of a failed payment, your order will not be processed.

4. Right of Withdrawal (EU Consumers)

Under EU Directive 2011/83/EU (Consumer Rights Directive) and the Estonian Law of Obligations Act, EU consumers have the right to withdraw from a distance contract within 14 calendar days of receiving the goods, without giving any reason.

To exercise this right, notify us in writing at info@vainowear.com before the 14-day period expires. You must return the goods in their original, unused condition within 14 days of notifying us. Return shipping costs are borne by the customer unless the goods are faulty.

Exception: The right of withdrawal does not apply to goods that are clearly personalised or custom-made to the buyer's specifications.

5. Defective Goods & Legal Guarantee

Under Estonian and EU law, goods must conform to the contract of sale. If an item is defective or does not match its description, you have the right to a repair, replacement, price reduction, or refund under the 2-year legal guarantee (EU Directive 1999/44/EC, replaced by 2019/771/EU for contracts from 1 Jan 2022 onwards).

Please report defective items within a reasonable time of discovery. Contact us at info@vainowear.com with photos and a description of the issue.

6. Intellectual Property

All content on this website — including photographs, text, patterns, and designs — is the property of MV Kudumine OÜ or its licensors and is protected by copyright. You may not reproduce, distribute, or use any content without prior written permission.

7. Privacy & Data Protection

We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and the Estonian Personal Data Protection Act. We collect only the data necessary to fulfil your order (name, address, email, phone). We do not sell your data to third parties. For full details, see our Privacy Policy.

8. Limitation of Liability

To the fullest extent permitted by applicable law, MV Kudumine OÜ is not liable for any indirect, incidental, or consequential damages arising from the use of our products or website. Our total liability in any matter arising from these terms shall not exceed the value of the order in question.

Nothing in these terms affects your statutory rights as a consumer under Estonian or EU law.

9. Dispute Resolution

These Terms & Conditions are governed by the laws of Estonia. In the event of a dispute, we encourage you to contact us first. If we cannot resolve the matter amicably, EU consumers may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Estonian consumers may also contact the Consumer Protection and Technical Regulatory Authority (TTJA).

10. Changes to These Terms

We may update these Terms & Conditions from time to time. The current version will always be published on this page with its effective date. Continued use of the website after changes constitutes acceptance of the updated terms.
